Under Federal Statute 924 (c) there are certain distinction that greatly effect the sentence that the court is obligated to impose.
If you are charged with possession of a Firearm during a Federal Offense the Statute calls for a minimum sentence of 5 years consecutive to your underlying offense to be imposed. The court does not have discretion as to this. A consecutive sentence is one that is added to the original sentence. As opposed to a concurrent sentence, which can be served at the same time as the other charge.
If you are found to have brandished the firearm, more commonly known as display, then the statute states a minimum mandatory consecutive sentence of 7 years shall be imposed by the court.
If you are found to have discharged the firearm, then the statute state a minimum mandatory consecutive sentence of 10 years shall be imposed by the court.
