When is my license suspended if I get
a DUI?
In Miami and Fort Lauderdale, your license is suspended immediately when you are arrested for criminal DUI. However, under the Administrative Rules of the Florida DMV you have 10 days to request a formal review hearing where a DMV hearing officer will hear the facts of your case and make a determination whether or not to uphold your driver's license suspension. For the first 10 days after your arrest for DUI your criminal DUI citation/ticket will act as your temporary restricted driver's license. After those 10 days, if you properly request a formal review hearing with the DMV, they will give you an extended temporary restricted driver's permit that allows you to drive until your case is heard by the DMV.
